  • Orders mean a request by You to purchase Goods from Us via the Website or point-of-sale (e.g., farmers’ markets).
  • Subscriptions refer to recurring purchases of Goods offered by the Company.
  • Terms and Conditions (also “Terms”) mean these Terms and Conditions forming the agreement between You and the Company regarding the use of the Website and purchase of Goods.
  • Third-party Social Media Service means services or content provided by a third party that may be displayed or included on the Website.
  • Website refers to Viva Tallow, accessible from vivatallow.com.
  • You means the individual accessing or using the Website, or a company/legal entity on whose behalf the individual acts.

These Terms and Conditions govern the use of the Website and the purchase of Goods from Viva Tallow LLC, whether through the Website or at point-of-sale locations (e.g., farmers’ markets). They set out the rights and obligations of all users.

Your access to and use of the Website, or purchase of Goods, is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access the Website or purchase Goods.

By accessing the Website or purchasing Goods, You agree to be bound by these Terms. If You disagree, You may not access the Website or purchase Goods.

If You are under 18, You must have parental permission to use the Website or purchase Goods.

Your use of the Website is also conditioned on Your acceptance of Our Privacy Policy, available at vivatallow.com, which describes Our policies on personal information collection, use, and disclosure, including cookies and email marketing. Please read the Privacy Policy carefully.

Product Use and Disclaimers

  • Intended Use: Goods are for external use only. They are not for ingestion or food use.
  • Warnings:
    • Do not use on broken or damaged skin.
    • Avoid contact with eyes; rinse thoroughly with water if contact occurs.
    • Apply as needed to clean, dry skin. Perform a patch test before full application to check for sensitivities. Goods contain ingredients that may cause sensitivities.
    • Discontinue use and consult a physician if irritation, redness, or allergic reaction occurs.
    • Keep out of reach of children. If swallowed, get medical help or contact a Poison Control Center immediately.
    • Consult a healthcare professional before use on children under 6 months or if you have sensitive skin or known allergies to the ingredients. 
  • Storage Instructions: Protect Goods from excessive heat and direct sun
  • Liability: Goods are used at Your own risk. Goods sold as a cosmetic and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Results may vary based on individual skin type and usage. Viva Tallow LLC is not liable for adverse reactions, injuries, or damages resulting from improper use, failure to follow instructions, or individual sensitivities. Always perform a patch test before full application. The statements on this Website have not been evaluated by the Food and Drug Administration.

Soap

  • Superfat: Soap with superfat is designed for gentle cleansing; individual skin reactions may vary.

Candle

  • Warning: Never burn candles on or near anything that can catch fire. Trim wick to 1/4" each time you light. Burn in a ventilated area but keep away from drafts. Burn candle on heat resistant surface or in suitable holder. Do not move while lit or until tallow hardens. Discontinue use when 1/2" tallow remains in bottom. Keep free of foreign objects. For indoor use only. Burn at least for one hour per inch of candle diameter each time candle is lit to ensure the best burning efficiency. Do not burn longer than 4 hours at one time.

Sun Cream

  • Product Purpose: This sun cream is a cosmetic product designed to moisturize, soothe, and support the skin’s natural barrier. It contains non-nano zinc oxide for cosmetic benefits, such as reducing irritation and enhancing skin texture. Despite its name and ingredients, this product is not a sunscreen and does not provide protection against sunburn, UV radiation, skin cancer, or premature skin aging. For UV protection, use a broad-spectrum sunscreen with an SPF rating and follow sun safety practices, such as wearing protective clothing and limiting sun exposure.
  • Reef-Safe Claim: This product is formulated without ingredients banned in reef-protective regions for sunscreens (e.g., oxybenzone, octinoxate, prohibited in Hawaii and Palau). While designed as a cosmetic, its ingredients are selected to minimize environmental impact. Check local regulations before use in areas with cosmetic or sunscreen restrictions.
  • Limitation of Liability: This product is not intended to provide UV protection or treat skin conditions. Results may vary based on skin type and usage. Viva Tallow LLC is not liable for adverse reactions, injuries, or damages resulting from improper use, failure to follow instructions, or individual sensitivities to ingredients.

Placing Orders for Goods

By placing an Order for Goods through the Website or at point-of-sale, You warrant that You are legally capable of entering into binding contracts.

Your Information

To place an Order, You may be asked to supply information relevant to Your Order, including Your name, email, phone number, credit card number, expiration date, billing address, and shipping information.

You represent and warrant that: (i) You have the legal right to use any payment method in connection with Your Order; and (ii) the information You supply is true, correct, and complete.

By submitting such information, You grant Us the right to provide it to payment processing third parties to facilitate Your Order.

Order Cancellation

We reserve the right to refuse or cancel Your Order at any time for reasons including:

  • Goods availability.
  • Errors in description or prices.
  • Errors in Your Order.
  • Suspected fraud or unauthorized/illegal transactions.

Your Order Cancellation Rights

All Orders are final. You have no right to cancel an Order once placed, as Goods are personal care products. See “Returns and Refunds” for details on Our satisfaction guarantee and refund policy.

Availability, Errors, and Inaccuracies

We regularly update Our Goods on the Website. Goods may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information.

We do not guarantee the accuracy or completeness of information, including prices, images, specifications, or availability. We reserve the right to change or correct errors, inaccuracies, or omissions at any time without notice.

Prices Policy

Prices are in USD, exclusive of taxes, which are added at checkout. We reserve the right to revise prices at any time prior to accepting an Order.

Prices may be revised after accepting an Order due to government action, customs duties, increased shipping costs, or other matters beyond Our control. In such cases, You may cancel Your Order.

Payments

Goods are subject to a one-time payment or subscription billing. Payment methods include credit cards (Visa, MasterCard, American Express) and Shopify Payments.

Payment cards are subject to validation and authorization by Your card issuer. If authorization is not received, We are not liable for delays or non-delivery.

Subscriptions

Subscription Period

All Goods are eligible for subscription, available only with a paid Subscription. You will be billed in advance on a recurring basis (e.g., bi-weekly or monthly), depending on Your selected plan.

Subscriptions automatically renew under the same conditions unless You or the Company cancels.

Subscription Cancellations

You may cancel Your Subscription anytime through Your Account settings or by contacting Us at info@vivatallow.com or 612-440-1275. Cancellation takes effect at the end of the current billing period. No refunds are issued for fees paid for the current period.

Billing

You shall provide accurate and complete billing information, including full name, address, state, zip code, phone number, and valid payment method.

If automatic billing fails, We will issue an electronic invoice requiring manual payment within a specified deadline for the billing period.

Fee Changes

We may modify Subscription fees at any time, effective at the end of the current billing period. We will provide reasonable prior notice of fee changes, allowing You to cancel before changes take effect. Continued use after fee changes constitutes agreement to pay the modified amount.

Refunds

Paid Subscription fees are non-refundable, except as required by law. Certain refund requests may be considered case-by-case at Our discretion.

User Accounts

When creating an Account, You must provide accurate, complete, and current information. Failure to do so may result in Account termination.

You are responsible for safeguarding Your password and all activities under Your Account. Notify Us immediately at info@vivatallow.com of any security breach or unauthorized use.

You may not use a username that is unlawful, another’s name/trademark, or offensive.

Content

Your Right to Post Content

The Website allows You to post Content (e.g., reviews). You are responsible for the legality, reliability, and appropriateness of Your Content.

By posting Content, You grant Us a non-exclusive, royalty-free license to use, modify, display, reproduce, and distribute it for marketing purposes. You retain Your rights to Your Content and are responsible for protecting those rights.

You warrant that: (i) You own the Content or have the right to use it; and (ii) Your Content does not violate privacy, publicity, copyright, or other rights.

You may not post Content that is unlawful, offensive, defamatory, or otherwise objectionable, including:

  • Unlawful or promoting unlawful activity.
  • Defamatory, discriminatory, or mean-spirited content targeting protected groups.
  • Spam, unauthorized advertising, or gambling.
  • Viruses, malware, or harmful content.
  • Infringing proprietary rights.
  • Impersonating others or violating privacy.

We reserve the right to remove or refuse Content that violates these Terms and to limit or revoke Website access for posting objectionable Content. You use the Website at Your own risk and agree We are not liable for third-party Content.

Content Backups

We perform regular Content backups but do not guarantee against loss or corruption. You agree to maintain Your own Content backups. We are not liable for Content integrity or failure to restore Content.

Copyright Policy

We respect intellectual property rights and respond to claims of Content infringing copyright or other rights.

The Website may contain links to third-party sites not controlled by Us. We are not responsible for their content, privacy policies, or practices. You use such sites at Your own risk and should review their terms and privacy policies.

Termination

We may terminate or suspend Your Account without notice for any reason, including breach of these Terms. Upon termination, Your right to use the Website ceases. To terminate Your Account, discontinue using the Website.

Limitation of Liability

Our liability under these Terms is limited to the amount You paid for Goods or $100 if no purchase was made.

To the maximum extent permitted by law, We and Our suppliers are not liable for special, incidental, indirect, or consequential damages (e.g., personal injury, allergic reactions, loss of data) arising from Website or Goods use, even if advised of such damages.

Some states may not allow certain liability limitations, in which case limitations apply to the greatest extent permitted.

“AS IS” and “AS AVAILABLE” Disclaimer

The Website and Goods are provided “AS IS” and “AS AVAILABLE” without warranties. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

These Terms are governed by Minnesota law, excluding conflicts of law rules. Your use of the Website may also be subject to other local, state, or federal laws.

Disputes Resolution

For concerns or disputes, contact Us at info@vivatallow.com or 612-440-1275 to attempt informal resolution. Disputes not resolved informally will be handled in the state or federal courts of Hennepin County, Minnesota. You consent to this jurisdiction.

United States Legal Compliance

You warrant that You are not located in a country subject to U.S. government embargo or designated as a “terrorist supporting” country, and You are not on any U.S. government prohibited/restricted party list.

Severability and Waiver

Severability

If any provision is unenforceable, it will be interpreted to accomplish its objectives to the greatest extent possible, and other provisions remain in effect.

Waiver

Failure to exercise a right or require performance does not waive that right or performance in the future.

Changes to These Terms and Conditions

We may modify these Terms at any time. Material changes will be notified at least 30 days prior via the Website. Continued use after changes constitutes agreement to the revised Terms. If You disagree, stop using the Website.
